Access Copyright Fight Goes To Federal Court of Appeal

York University Appeal hearing: Access Copyright Legal team appeared before the Federal Court of Appeal in Ottawa on March 5 and 6 for the appeal hearing in the legal action between Access Copyright and York University. Access Copyright defending the interests of Canadian creators and publishers.
 
A previous decision issued by the Federal Court of Canada on July 12, 2017 was a victory for rightsholders. It made two  conclusions: The copying policy adopted by York University – which is virtually identical to the policies adopted across the education sector – does not meet the Supreme Court of Canada’s test for fair dealing. Tariffs are mandatory. There is no “opting-out. A decision is expected from the Federal Court of Appeal by the end of this year or early in 2020.
